CHICAGO-A judge granted preliminary injunctive relief to Lincolnwood, Ill., independent wireless dealer Kempner Mobile Electronics in its legal battle against Cingular Wireless L.L.C. The court’s decision allows Kempner to offer competing service offerings at its retail locations, though it prohibits the dealer from directly or indirectly switching Cingular subscribers to a different service.
The injunction hearing was part of a $25 million lawsuit filed by Kempner against Cingular in May 2001 alleging fraud, deceptive trade practices, coercion, theft of customers, intimidation and contract violations arising from Cingular’s attempt to drive independent dealers out of business.
