COURT RULES ON CASE CONCERNING UNIVERSAL SERVICE

WASHINGTON-The U.S. Court of Appeals for the Fifth Circuit in New Orleans ruled largely in favor of the Federal Communications Commission late Friday in a widely watched case involving universal service. While specific details of the decision were not available at press time, the FCC said the court did grant in part some of what the appealing parties-several states and the telecom industry-wanted.

The case could potentially have a big impact on the administration of the often-controversial universal service program.

One issue that could impact wireless concerns eligibility for receiving universal-service support subsidies. It is reported the court said the FCC could not prohibit states from imposing their own eligibility requirements.

The wireless industry has been urging the FCC to institute federal guidelines for eligibility.
