BOTHELL, Wash.—Data Critical Corp. said its dispute continues with Medtronic Physio-Control Corp., which distributes Data Critical’s alarm notification products.
Data Critical claims Medtronic failed to meet minimum end user distribution targets and to pay about $2.5 million in past due invoices for minimum payment obligation under the previously signed distribution agreement. The company said it will pursue all possible legal remedies to ensure Medtronic fulfills its contractual obligations.
Last week, Medtronic responded by filing a formal demand for arbitration with the American Arbitration Association seeking relief from all future and past minimum payment obligations. Data Critical said it plans to file a response with the association denying Medtronic’s claims and seeking counterclaims for breach of contract and compensation for damages.
